Taranto and Vodzak’s Successful Venue Transfer

Damian Taranto and Matt Vodzak were retained to represent a corporate defendant in a wrongful death action filed in Philadelphia County. Attorneys Taranto and Vodzak filed venue preliminary objections arguing that all of the corporate defendants and the property owner were all located and solely conducted business outside of Philadelphia. Further, they argued that puffery statements contained within prior advertising referencing the ability to service areas in/near Philadelphia did not avail defendants to jurisdiction in Philadelphia. Following the filing of venue preliminary objections, as well as venue written discovery and depositions, plaintiff’s counsel agreed to withdraw his opposition to venue and execute a stipulation consenting to transfer of the case to another county within the Commonwealth.
