
Fowler and Garson Secure Defense Verdict
On February 26, 2025, Joe Fowler and Sam Garson obtained a defense verdict in a commercial auto accident case after a six-day trial in the matter of Fleurelus v. Howard, et al. in the Philadelphia County Court of Common Pleas. Attorneys Fowler and Garson represented Silvi Concrete of Philadelphia and its driver, Chrisian Howard. Plaintiff, who was represented by Morgan & Morgan, demanded $1 million prior to the start of the trial for alleged permanent injuries including a torn rotator cuff requiring surgery. Plaintiff also alleged that she was unable to return to work as a certified nursing assistant and had $140k in boardable medical specials.
The defense was able to prove that the defendant driver was faced with a sudden emergency when he was cut off by a phantom vehicle that caused him to veer into the left lane of travel resulting a collision with Plaintiff’s vehicle. The defense also presented compelling evidence that Plaintiff’s alleged injuries were degenerative or preexisting and not related to the subject accident. The jury unanimously agreed that the defendant’s driver was not negligent in any way.
